What you are dealing with

Traffic charges that put you in the Canton jail

Cherokee County State Court hears all misdemeanor and traffic criminal cases filed with the Clerk. City citations stay in municipal court — Woodstock on Mondays, Canton on the second and fourth Wednesday, Holly Springs on the second and fourth Tuesday, Ball Ground on the third Friday.

The charges that actually produce an arrest and a trip to 498 Chattin Drive are the serious ones: driving on a suspended or revoked licence, habitual violator, reckless driving, fleeing or attempting to elude, laying drags, and organising or promoting a drag racing exhibition. Under O.C.G.A. § 17-6-12, all of those are bail restricted offenses, along with reckless stunt driving on a second or subsequent offense.

Canton also operates school-zone speed cameras, which are handled separately from municipal court through a citation processor — those are civil notices, not arrests.

Fast facts

This page is general information about Georgia law and Cherokee County practice. It is not legal advice, and it is no substitute for a lawyer. Charges, bond conditions and court dates vary case by case.

The law behind it

What Georgia law says

Bail restricted traffic offenses

O.C.G.A. § 17-6-12 includes habitual violator, DUI, reckless stunt driving (second or subsequent), promoting or organising a drag racing exhibition, laying drags, reckless driving (second or subsequent), and fleeing or attempting to elude a police officer. Unsecured judicial release is unavailable for any of them.

Suspended licence stacks

A suspended licence charge frequently arrives alongside the reason the person was stopped, and each bonded charge carries its own bond and its own $50 statutory minimum premium.

Municipal courts do not remind you

Woodstock states plainly that if you miss court a fine is assessed, your driver’s licence may be suspended and an arrest warrant may be filed. Mountain Park publishes that no court date reminders are sent automatically. Assume nobody will call you.

The sequence

What happens after the arrest

01

Booking at the ADC

Everyone arrested in Cherokee County is booked at 498 Chattin Drive in Canton. Nothing can be posted until booking is complete.

02

First appearance

A Magistrate judge sets bail. Georgia law requires this within 48 hours of a warrantless arrest, 72 hours on a warrant. Cherokee Magistrate Court sits 24/7/365.

03

Bond is written

A co-signer signs with photo ID, in person in Canton or remotely by email or fax. We pay the 15% premium terms and post the full bond.

04

Release and court dates

The jail processes the release. From that point, every court date matters — missing one forfeits the bond and triggers a bench warrant.

Straight answers

Traffic & Suspended License Bail Bonds: questions we get every week

No. A citation you sign and are released on is not a bond. If the person was physically taken to the Cherokee County jail, then yes.

Because in Georgia it is a criminal misdemeanor, not a civil infraction, and it is on the bail restricted list. Officers have arrest authority and frequently use it.

That is between you and the towing company, not the jail. Personal property held at the ADC is a different matter — property pickup is Monday to Friday, 9:30 a.m. to 5:30 p.m., with valid photo ID. Property Deputy: 678-493-4212.

Look at the citation. If a city officer wrote it, it names the municipal court. If a deputy or the State Patrol wrote it, it is usually Cherokee County State Court at 90 North Street.
