The felony court, and the only court that can bond certain charges
Cherokee County Superior Court is the general jurisdiction court, with authority to hear all civil and criminal cases and exclusive jurisdiction over felonies, plus divorce, equity and land title cases. It sits in the Frank C. Mills III Justice Center at 90 North Street, Canton, GA 30114. Offices are open Monday to Friday, 9:00 a.m. to 5:00 p.m.
Cherokee County is the sole county in the Blue Ridge Judicial Circuit. The circuit was created in 1851 with eleven counties; the mountain counties split off in 1983 to form the Appalachian Circuit, and Forsyth County left on 3 July 1998, leaving Cherokee alone. Four Superior Court judges hear every felony in the county.
For bail purposes the critical point is O.C.G.A. § 17-6-1(a): a list of the most serious offenses in Georgia is bailable only before a judge of the Superior Court. A Magistrate judge at first appearance cannot touch them.

The offenses only a Superior Court judge can bond
O.C.G.A. § 17-6-1(a) names them. If the charge is on this list, nothing happens until a Superior Court judge sets a bond.
- Treason, murder, rape, aggravated sodomy
- Armed robbery, home invasion in the first degree
- Aircraft hijacking and hijacking a motor vehicle in the first degree
- Aggravated child molestation, aggravated sexual battery
- Manufacturing, distributing, delivering, dispensing, administering or selling Schedule I or Schedule II controlled substances
- Drug trafficking under 16-13-31 and 16-13-31.1
- Kidnapping, arson, aggravated assault or burglary where the accused had a qualifying prior or was on probation, parole or bail
- Arson of a law enforcement vehicle
- Aggravated stalking
- Trafficking of persons for labor or sexual servitude
- Criminal street gang offenses under Chapter 15 of Title 16
