Where a Cherokee County misdemeanor actually goes
Cherokee County State Court hears “all misdemeanor and traffic criminal cases filed with the Clerk,” and it sits in the same Justice Center at 90 North Street as Superior Court. Chief Judge W. Alan Jordan, Judge A. Dee Morris and Judge Michelle L. Helhoski preside, and the court also runs DUI Court and Veterans Court accountability programs.
City charges are different. A citation written by Canton PD, Woodstock PD, Holly Springs PD or Ball Ground PD for a city ordinance stays in that city’s municipal court — which usually sits once or twice a month. That single fact causes more accidental bench warrants than anything else we see.
A useful thing to know: State Court judges will allow a Georgia-licensed attorney to waive arraignment by filing a waiver with the State Court Clerk’s Office. That is worth asking your lawyer about early.

What Georgia law says
SB 63 pulled a lot of misdemeanors into secured bail
Effective July 1, 2024, Senate Bill 63 added roughly thirty offenses to Georgia’s bail restricted list, including criminal trespass on a second or subsequent offense, failure to appear on a second or subsequent offense, theft by taking on a second or subsequent offense, reckless driving on a second or subsequent offense, obstruction of a law enforcement officer, riot, inciting to riot and unlawful assembly. If the charge is on that list, an unsecured judicial release is off the table — somebody has to post.
Municipal court schedules are unforgiving
Woodstock Municipal Court sits Mondays at 9:00 a.m. and 1:00 p.m. Canton publishes a list of specific court dates each year rather than a fixed weekly rule. Holly Springs sits the second and fourth Tuesday. Ball Ground sits the third Friday at 10:00 a.m. Miss it and, in Woodstock’s own published words, a fine is assessed, your driver’s license may be suspended and an arrest warrant may be filed.
Keep your address current with the court
Woodstock’s court states that the address on your citation is where all official correspondence is mailed. If you move and do not tell the clerk, you will not get the notice — and the court will not accept that as an excuse.

What happens after the arrest
Booking at the ADC
Everyone arrested in Cherokee County is booked at 498 Chattin Drive in Canton. Nothing can be posted until booking is complete.
First appearance
A Magistrate judge sets bail. Georgia law requires this within 48 hours of a warrantless arrest, 72 hours on a warrant. Cherokee Magistrate Court sits 24/7/365.
Bond is written
A co-signer signs with photo ID, in person in Canton or remotely by email or fax. We pay the 15% premium terms and post the full bond.
Release and court dates
The jail processes the release. From that point, every court date matters — missing one forfeits the bond and triggers a bench warrant.

Fifteen percent of the bond amount, minimum $50 per bonded charge, under O.C.G.A. § 17-6-30. On a $2,000 misdemeanor bond that is $300.
You can. The Cherokee County Sheriff accepts cash or cashier’s check for the full bond plus a $20 non-refundable state fee in exact change, and there is an online portal that adds a $10 automation fee plus 5%. The cash comes back at the end of the case. For most families the 15% premium is far less painful than tying up the whole amount.
Often not — many city citations are payable without an appearance, and Holly Springs and Mountain Park both publish which violations can be paid in advance. But if someone was physically arrested and taken to the ADC in Canton, a bond has to be posted.
A bench warrant. Call the clerk immediately — Woodstock allows one continuance requested in person before the original date, and other courts have their own practices. Once a warrant issues, the next stop is the Cherokee County jail again.
