When a bond stops working
Most bonds end quietly. The defendant goes to every court date, the case resolves, the court exonerates the bond and nobody thinks about it again.
Sometimes that does not happen. Calls stop being returned. A court date is missed. A co-signer realises the person they vouched for has stopped showing up — and under Georgia law that co-signer is now facing liability for the full face amount of the bond.
007 Footloose Offender Services is the part of our operation that handles those situations: surrender, recovery and offender services work, coordinated with the bonding company so the co-signer is protected as far as the statute allows.
Why timing decides everything
- The judge forfeits the bond and issues a bench warrant at the end of the court day
- The clerk must serve notice on the surety within 10 days
- The execution hearing is set 150 to 180 days after the failure to appear
- Surrendering the principal within 150 days of judgment limits the surety to costs plus 5% of the face amount
- 95%, 50% and 100% remission tiers each have their own conditions and deadlines
What we handle
- Voluntary surrender — arranging for a defendant to be returned to custody before a forfeiture judgment lands
- Co-signer counselling — explaining exactly where the statutory clock stands and what options remain
- Court coordination — working with the clerk to reset a case where that is still possible
- Detainer requests — where the principal is in custody in another jurisdiction, Georgia law provides a route and a ten business day deadline
- Recovery — licensed bail recovery agents, registered with the sheriff as O.C.G.A. § 17-6-56 requires
If you are a co-signer reading this at midnight: call 770-224-9150. Do not wait until the execution hearing notice arrives. Almost everything the statute allows us to do gets harder with time, and several of the remission tiers close permanently.
Recovery agents in Georgia are regulated
O.C.G.A. § 17-6-56 requires a bail recovery agent to be a United States citizen aged 25 or older and licensed under Code Section 16-11-129. Sheriffs require professional bondsmen to register their recovery agents and to submit a list of all agents whose services may be used. Cherokee Bail Bonds operates within that framework, on the Cherokee County Sheriff’s approved bonding company list.
